Terms of Service

These terms govern your use of Æthelstan (“the service”), an operated agent that runs social media on your behalf, operated by Ezra Reichel (“we”, “us”). By connecting an account or using the service, you agree to these terms. If you are agreeing on behalf of a business, you confirm you are authorised to do so.

The service

Æthelstan researches, creates, schedules, publishes and measures content on the accounts you connect. You choose the level of autonomy: in review mode nothing is published until you approve it; in autopilot mode you authorise the agent to publish within the scope and settings you have configured. You can change this, or pause posting entirely, at any time.

Your responsibilities

• You own or are authorised to operate the accounts you connect, and to publish the content produced for them.
• You hold the rights to any brand assets, materials or information you provide to the agent.
• You will comply with the terms and community guidelines of each platform you connect (Meta, LinkedIn, TikTok and others), and you remain responsible for content you approve or that is published under autopilot settings you enabled.
• You will not use the service for anything unlawful, infringing, deceptive, or that violates a platform’s rules, and you will not use it to send spam or harass.

Platform dependencies

The service depends on third-party platform APIs. Those platforms can change, limit, or withdraw access, or experience outages, and some capabilities (for example, direct publishing on a given platform) depend on that platform’s approval. We are not responsible for a platform’s own acts, changes or downtime, though we will work in good faith to keep the service running.

What we do and don’t promise

We will operate your account with care and report performance honestly, measured against real benchmarks. We do not guarantee any particular result — reach, growth, engagement, revenue or otherwise. Social outcomes depend on many factors outside our control, and any figures we share describe measured past performance, not a promise of future results.

Intellectual property

You keep all rights to your brand, your accounts and the content produced for you. We keep all rights to the Æthelstan software, models configuration and the shared craft library that powers the service. You grant us the limited licence needed to operate your accounts and create and publish content on your behalf.

Fees

Fees, scope and term are set out in the quote or order you agree with us. Unless that document says otherwise, fees are payable as stated there.

Termination

Either of us may end the service as set out in your order, or on reasonable notice if none is stated. You can disconnect your accounts at any time, which stops the agent from acting on them. On termination we handle your data as described in the Privacy Policy and Data Deletion page.

Disclaimers & liability

The service is provided on a reasonable-efforts basis and, to the extent permitted by law, without warranties of any kind. To the extent permitted by law, our total liability arising from the service is limited to the fees you paid for it in the three months before the event giving rise to the claim, and we are not liable for indirect or consequential loss. Nothing in these terms limits liability that cannot be limited by law.

Governing law

These terms are governed by the laws of the United States and of the U.S. state in which Æthelstan is established, as set out in your order, and you agree to the exclusive jurisdiction of the courts located there.
